The departures board flips to red: ‘Cancelled’. First that brief moment of blankness, then everyone runs for the desk at once. If you’ve been there, you know this is exactly when it’s decided whether you’ll have 600 euros in your account three weeks from now — or a 15-percent voucher for the onboard bistro. Most travellers give away real money in this situation simply because they don’t know their rights. The legal position is refreshingly clear. Here it is, compact enough for the queue at the gate.
Does this even apply to my flight?
Short answer: almost always, if you’re departing from Switzerland or the EU. EU passenger rights regulation 261/2004 covers all departures from the EU, as well as flights into the EU operated by EU airlines — and Switzerland has adopted the whole thing, so Zurich, Geneva and Basel are protected just like Frankfurt or Paris. The one gap worth knowing: the return flight from a non-EU country on a non-EU airline, say from Bangkok with a Gulf carrier. In that case, only the airline’s own contract terms apply — one more reason to choose the European airline when the price difference is small.
Your three trump cards when a flight is cancelled
Trump card one: choice. The airline must offer either a full refund for the ticket (within seven days, in money — you do not have to accept a voucher, no matter how charmingly worded it is), or rebooking at the earliest opportunity, or rebooking for a date of your choice. Trump card two: care. After two hours of waiting, you’re entitled to meals and drinks; if an overnight stay is needed, the hotel and transfers too. If the airline organises nothing, keep every receipt — you can claim the money back. And trump card three, the big one: flat-rate compensation on top. 250 euros up to 1,500 kilometres, 400 up to 3,500, 600 above that. Condition: the airline informed you less than 14 days before departure, and there was no ‘extraordinary circumstance’.
‘Extraordinary circumstances’ — every airline’s favourite phrase
You’ll hear this term, promised. It means things outside the airline’s control: severe weather, air traffic control strikes, bird strikes. What airlines like to leave out: according to established case law, technical defects almost never count — maintenance is their job. And even strikes by their own staff are not a free pass under European Court of Justice rulings. Our advice: never let a blanket refusal fob you off. Ask for the reason in writing. Surprisingly often, that ‘regrettable extraordinary circumstance’ suddenly turns into a bank transfer.
How to get your money — without a lawyer
At the airport: photograph the departures board, keep the cancellation email, save every receipt and have the cancellation and its reason confirmed in writing. Back home: fill in the airline’s compensation form — every airline has one, usually buried deep in the website — and give them a 30-day deadline. If nothing happens, for departures from Switzerland you can file a free complaint with the FOCA, and in the EU with the national mediation bodies. The well-known flight-rights platforms will handle everything for you, but they take 25 to 35 percent commission. If the case is clear-cut, writing the letter yourself is almost always worth trying first — it takes twenty minutes and not a Rappen.
